Sakaja given up to noon to respond to degree queries

BY JOAN WANJIKU,NAIROBI,13TH JUNE,2022-Nairobi Senator Johnson Sakaja, who is facing four petitions seeking to bar him out from the city’s gubernatorial race, has been allowed to file evidence in all of them by noon Monday.

The Independent Electoral and Boundaries Commission (IEBC) Dispute Resolution Committee chaired by Titus Tiego granted a plea by Sakaja’s lawyer, Adrian Kamotho, to be given more time to respond to the petitions.

There are four petitions have been filed against the senator seeking to have his clearance revoked on various grounds, including lack of educational qualifications.
The tribunal has also issued an order consolidating all the four petitions and directed the returning officer and the complainants to file their responses by close of business on Tuesday.

The consolidated petitions will be heard June 15 starting from 2pm.

On Saturday, IEBC set up 3 Panels to hear the disputes arising from the recently concluded registration of candidates for different elective positions.

IEBC Chairman Wafula Chebukati who presided over the launch of the Commission Dispute Resolution Committee Hearings at the Milimani Law Courts said 262 complaints have been filed so far.

He said IEBC is responsible for settling electoral disputes, including disputes relating to or arising from nominations but excluding election petitions and disputes subsequent to the declaration of election results.

“The Dispute Resolution Committee will hold its hearings for the next 10 days at Milimani Law Courts each panel will deliver rulings within 48 hours of hearing,” He said.
This is in compliance with section 74 of the Elections Act which provides that electoral disputes shall be determined within ten days of the lodging of the dispute with the Commission.

Chebukati, the Returning Officer for the Presidential election, will not sit in any of the panels.

Each of the three empanelled Dispute Resolution Committee Panels will contain a Presiding Chairperson, Committee Members and Secretaries to the respective Panels.
