CAJ petitioned over failure to investigate DPP,activist wants it disbanded

BY JOAN WANJIKU,NAIROBI,7TH FEB,2022-Activist Charles Rubia has filed a Judicial Review against the office of the Commission on Administrative Justice (Ombudsman) for failing to take legal action against the Director of Public Prosecution.

Rubia through lawyer Dunstan Omari seeks to compel the office of the Ombudsman to investigate the DPP on allegations of maladministration, administrative injustice, incompetence, misbehavior and inefficiency within public service.

According to Rubia, the Judicial Review comes after the office of the Ombudsman failed to take legal action against the Director of Public Prosecution, approximately 3 months after being petitioned.

Rubia argues that the office of the ombudsman should be disbanded if it fails to probe the allegation against the DPP.

Meanwhile, former Nairobi Governor Evans Kidero and 9 others have filed an appeal seeking to stop the execution of a judgment and seek injunction against the EACC from investigating or seizing property belonging to Kidero pending hearing and determination of the appeal.

Kidero further sought a temporary injunction restraining EACC from purporting to investigate or search his properties or placing a caveat pending hearing and determination of the matter.

This even as 3 people, Andrew Onsando Orina, David Elikana Nyabuto and Eric Manyange Ondieki were charged for conspiring to steal a Ksh 50,000-television belonging to the Judiciary.

Appearing before Chief Magistrate Wendy the three pleaded not guilty to the charges.

Ondieki was granted a cash bail of Ksh 100,000 the case will be mentioned on 19th February for pretrial hearing.

Elsewhere Nathan Loyd Ndungu a Kenyan businessman and an American citizen who is wanted in Rwanda to serve a five-year jail term for alleged fraud charges has been granted a Ksh 1 million bond.

The state had sought to detain him for 21 days as they wait for the extradition request from Rwanda.
He was ordered to surrender his passport and travel documents in court until the matter is determined.
