Court dismisses plea by Former (NOCK) official Stephen Soi’ to be released on bail,says he can be treaed in jail.

BY NAMULONGO PETER,NAIROBI,3RD FEB,2022-Former National Olympic Committee of Kenya (NOCK) official Stephen Soi’s application to be released on bail pending the outcome of his appeal case has been denied by the Kenyan High Court. 

Soi, who sought to be released on bail, citing his need for frequent medical attention due to several chronic illnesses, can get medical attention from prison, according to High Court Judge Lady Justice Esther Maina, who delivered the ruling on Thursday.

The 65-year-old, who applied for a certificate of urgency, stated that he was unhappy with the sentence and conviction.

“The appellant requires constant medical check-ups and as such being held in custody may limit his rights to access to medical attention,’’argued Soi

He claimed that his appeal is arguable with high chances of success and if bail was not granted at this stage, the appeal would  be rendered nugatory.

Soi was sentenced to 17 years in prison in September of last year after failing to raise the 115 million fine imposed on him for his role in the ‘Rio Scandal’.

According to Soi, he is apprehensive that his health will be greatly affected if his application to be released on bail pending appeal is not heard and determined expeditiously.

It is his argument that the magistrate erred in law by ruling that he unlawfully authorized payment of excess allowances to team Kenya.

He argues that he is not a flight risk adding that he never abscond court proceedings during his trial.

“The applicant was convicted in 6 counts and for crimes, he is said to have committed while in Nairobi yet there is overwhelming evidence that he was in Brazil at the material time,” he argues.
