Mwendwa was initially arrested on November 12 and spent a weekend behind bars before being released on bail of Sh4 million as investigations continued.
The DPP had been given seven days to prefer charges against Mwendwa but chose to close its file.
“We seek to close the file as our team proceeds with probing the case at our own pace before we prefer charges against him,” said the DPP on Thursday.
Milimani Senior Resident Magistrate Wandia Nyamu allowed the application by the DPP and ordered the matter closed.
Mwendwa was arrested over mismanagement of public funds disbursed to the federation by the government.
