BY KORIR JUMA,NAIROBI,14TH OCT,2021-Three police officers who were on duty when self-confessed serial killer Masten Wanjala escaped from police custody were on Thursday arraigned at the Milimani court.
The police are seeking for 14 days to detain the officers – Phillip Mbithi, Boniface Mutuma and Precious Mwinzi – to allow them conclude investigations.
In an affidavit by Chief Inspector Wanga Masake, the state says the three officers were arrested on October 13 on suspicion of having committed an offence of aiding a prisoner to escape contrary to Section 124 of the Penal Code.
Masake said the three were alleged to have neglected to prevent Wanjala’s escape – a duty they were bound to perform under the National Police Service Act.
“The offence occurred on the night of October 12 and 13 and the escapee has not been rearrested,” the affidavit states.
He further said preliminary investigations reveal the three neglected and aided the suspect escape from custody.
Lawyer Danstan Omari, representing the three cops, said he will oppose the application to detain his clients.
