Verdict:Court acquits 6 Kisumu MCAs of assault charges after agreement

BY CORRESPONDENT,25TH SEPT 2019-A magistrate court in Kisumu on Wednesday acquitted 6 Kisumu Members of County Assembly (MCAs) charged with assault and causing malicious damage.

The members were accused of assaulting the Assembly’s sergeant at arms George Amayo in October last year, charges they all denied.

The MCAs  who are  Seth Okumu of Seme East, Seth Kanga of Market Milimani, Joseph Olale of Nyalenda B, Ojwang Ogendo of Nyalenda A and Gard Olima of Central Nyakach  were acquitted under Section 204 of the Criminal Procedures Code.

Olale was also acquitted of a second charge of malicious damage to property. He was said to have damaged a mace rack valued at Sh20,000.

Kisumu County Acting Assembly Clerk Owen Ojuok made an application to withdraw the damage of property charge against Olale.

Both Ojuok and Amayo took to the witness stand and informed court that they intended to withdraw the charges against the six MCAs.

Consequently Prosecution Counsel Nyakundi Mokaya did not object to the withdrawal.
