BY NAMULONGO PETER,NAIROBI,17TH AUG 2018-Starehe MP Charles Kanyi Njagua is a happy man after court of appeal upheld his election.
The opposite is true however for ODM’s Steve Mbogo who had filed the appeal after Judge Agnes Murgor dismissed his appeal.Mgogo filed the appeal saying he had been dissatisfied with the judgement of High Court Justice Fred Ochieng’ in February.
The Court of Appeal agreed with Justice Ochieng’s finding that Mbogo did not provide sufficient evidence to support his claims that the election was marred by irregularities.
MINOR ISSUE
Futher Lady Justice Murgor ruled that failure by the Returning Officer to sign off Forms 35 A was a minor issue and did not have any impact on the results of the election.
It is not clear whether Mbogo will be heading to court to challenge the ruling once again.
