Court dismisses MP Jaguar’s bid to have bodaboda operators allowed within CBD

BY NAMULONGO PETER,NAIROBI,26TH MARCH 2018-Starehe Member of Parliament Charles Njagua has suffered a blow after high court dismissed the appeal he had filed against Move by Nairobi county government to kick bodaboda operators from Nairobi central district.The legislature wanted the operators allowed back within  the CBD.

However while making the ruling on the matter ,Judge Roselyn Aburili dismissed the case terming it  incompetent.

Justice Aburili threw out the case saying the legislator had failed to prove how the rights of the motorcyclists had been infringed following the ban.

Jaguar had implored the High Court to reverse the decision by the Nairobi County Government on grounds that it was discriminatory and will lead to loss of livelihood by many youths who depend on the motorcycles.

According to Justice Aburili , the county has the power to enforce laws it deems fit to restore the “glory” of the capital city.
