BY CORRESPONDENT,KISUMU,8TH JAN,2018-High court in Kisumu on Monday January 8 set 16th of February 2018 as the date for commencement of a public inquiry into the killers of baby Samantha Pendo .It will begin with a court mention on February 16.
Former director of public prosecution Keriako Tobiko had directed the court to start the process that will ensure that the perpetrators are arrested .He also said that senior police officers who were on duty during the incident face disciplinary action and that the family be compensated for emotional and physical torture.
Baby Pendo died in August last year after she was reportedly hit on the head by police in her parents’ house.
The officers were quelling chaos that rocked the lakeside city after President Uhuru Kenyatta was declared winner of the presidential elections.
The case was to be mentioned on Monday before chief magistrate Julius Ng’arng’ar but resident magistrate Beryl Omollo pushed it to next month.
“The National Police Service Commission should institute disciplinary proceedings against the commanders in question for being negligent and particularly for failing to coordinate the police operation in question…” reads part of the report.
Twenty one witnesses are set to testify in the case, They include the baby’s parents Joseph Abaja and Lenser Achieng and nine of their neighbours.
General Service Unit officers who were deployed to Nakumatt, Kachok and areas bordering Nyalenda estate will also testify.
All the witnesses have recorded statements and are waiting for court summonses.
a previous investigation by police did not bore any fruit prompting the DPP to intervene.
