BY KORIR JUMA,NAIROBI,25TH OCT 2017-The supreme court on Wednesday failed to issue the match waited ruling on a petition seeking to block Thursday’s fresh presidential election  after the bench fell short of required number of judges.

The Tuesday incident where the driver to deputy chief justice Philomena Mwilu was shot and injured on Ngong road was one reason which kept her away while justice Ibrahim Muhamed is still unwell and Njoki Ndungu was out of Nairobi.

The move prompted Chief Justice David Maraga  to say  there was no quorum for the case to proceed, since only he and Justice Isaac Lenaola were available to hear the matter.

He said a new date would be taken at the Court Registry
