High court dismisses petition seeking to bar IEBC chair Wafula Chebukati and other commissioners from presiding on repeat polls

BY KORIR JUMA,NAIROBI,9TH  OCT 2017-The High Court on Monday 9th Oct, dismissed a petition by three voters who were seeking to restrain Independent Electoral and Boundaries Commission (IEBC) Chairman Wafula Chebukati, his Commissioners and Chief Executive Officer Ezra Chiloba from overseeing the fresh presidential election slated for October 26.

While issuing the ruling Justice John Mativo said  that the case had no legal basis.

The  three petitioners Brian Asin, Ben Wanasakaami, and Kevin Alwang’a were seeking the order on basis  that the integrity of Chebukati and his team is in question following nullification by the Supreme Court of President Uhuru Kenyatta’s re-election.

They urged the court to bar the IEBC officials from holding the fresh election as directed by the Supreme Court.

The Supreme Court last month nullified President Kenyatta’s re-election citing  huge anomalies that marred the entire exercise.
