BY KORIR JUMA,NAIROBI,28TH SEPT 2017-A kibera law court on Thursday set free Embakasi East Member of parliament Babu Owino on a kshs 200,000 after he was arrested on Wednesday evening for assault.Owino was picked by police outside the milimani court on Wednesday immediately after he was released on a half a million bail in subversion and incitement charges.
The re-arrest of the lawmaker follows his alleged assault of Joshua Otieno whom he is accused of attacking on 8th of August in Kayole Nairobi. Owino is said to have inflicted serious injuries on the victim a move that led to him being hospitalized.While arguing out his case his lawyers Atiende Amollo and Nelson Havy urged the court to release him on bail since he was an elected member of parliament who has a duty to serve his electorate.
Earlier own in the day the director of public prosecution Keriako Tobiko had urged the prosecution to deny him bail saying the crime he committed was serious.But while making the ruling the judge said the accused had a right to be given bail as par the constitution.
