Appellate court Dismisses IEBC case on presidential votes tally

BY KORIR JUMA,NAIROBI,23RD JUNE,2017– five judge bench of the court of appeal  on Friday 23rd June  dismissed a case filed by the Independent Electoral Commission IEBC  on the tallying and announcing of presidential results.

The  appeal had been filed by the National Super Alliance NASA which is of the view that presidential results declared by the returning officer at the constituency polling station  are final and not subject to further verification from a central verification center in Nairobi.

Court of Appeal Judges Kathurima M’Inoti, William Ouko, Asike Makhandia, Patrick Kiage and Agnes Murgor who  gave the ruling  says it was improper to view the results as provisional bearing in mind that the same is  backed by law.

IEBC was challenging the high court ruling which earlier had upheld the same ruling.

The petitioner Maina Kiai  has praised the ruling of  the court of appeal ruling saying that the move will lower chances of stealing the votes to  nil.

The IEBC has however said it will file an appeal to the supreme court.

In the three hour rulling the judges have also come clear that IEBC must always ensure that it hires officials of high integrity in management of its business including the forthcoming elections.The ruling coming only 45days to the August 8 elections.
